Livingroom Analytics - Software Privacy Policy

 1.   Background

1.1   For the purpose of the Danish Data Protection Act, the data processor is Livingroom Analytics, Fruebjergvej 3, 2100 København Ø, Denmark, company registration number DK38840606 (hereinafter “Livingroom”, “we,” or “us”).

1.2   Livingroom has developed a secure online application to intelligently monitor, track and improve employee performance, engagement, and experience (hereinafter the “Software”).

1.3   An add-on to the Software is the mobile employee app (hereinafter the “App”), which can be accessed via a browser or installed on mobile devices and used in conjunction with the Software. Collectively the Software and the App shall be referred to as the “Service(s)”. The term “you” or “User” refers to any user of the Service.

1.4   Since we know that you care about how your personal information is used, we take your privacy seriously. By using any part of the Service, you accept what is outlined in this privacy policy (hereinafter the “Privacy Policy”).

1.5   This Privacy Policy covers our treatment of personally identifiable information (hereinafter “Personal Information”) gathered when you access and/or use our Services.

 

2.    Children Under the Age of 16

2.1   Our Services are not directed to children under the age of 16. We prohibit registration by and will not knowingly collect Personal Information from anyone under the age of 16. This requirement will be posted at points of data collection within our Services, e.g. when the User register for an account.

 

3.    Information We Collect From You

3.1   We collect information in several ways when you use our Services. The information is anonymized and aggregated in to the Service.

3.1.1   We gather some Personal Information when you register. When you register for an account, we will ask for Personal Information like your name and e-mail address to store with your account.

3.1.2   When registering a company with the Service, we also store Credit Card information in the Software.

3.1.3   We receive and store any information you provide to us in any way. The types of Personal Information collected include names, e-mail addresses and any other information necessary for us to provide the Service, including the usernames and passwords for any accounts created on the Service.

3.1.4   In the Service we also store information about your gender, race, educational level, job type and profile picture.

3.1.5   From the App we collect information related to you and your company’s engagement, performance, and experience.

 

4.   Information We Collect Automatically

4.1   We receive and store certain types of information of user interaction with our Services. We automatically receive and store the information on our server logs from your device ID and type, language, device operating system, access times, geographic location of device (if enabled), and third party services referred.

4.1.1   More generally, we automatically collect usage information, such as the numbers and frequency of user of the Service and its components.

4.2   We never disclose aggregate information to a partner in a manner that would identify a user personally.

 

5.    How We Use Your Information

5.1   In general we may use information that we collect about you to:

5.1.1   deliver and improve our Services, and manage our business;

5.1.2   conduct research to improve the algorithms that we use in the Service;

5.1.3   manage your account and provide you with customer support;

5.1.4   perform research and analysis about your use of the Service;

5.1.5   web and mobile application analytics;

5.1.6   enforce or exercise any rights in our Terms of use; and

5.1.7   perform functions or services as otherwise described at the time of collection.

 

6.   How We Share Received Personal Information

6.1   Personal Information about our customers is an integral part of our business. We neither rent nor sell your Personal Information to anyone. We share your Personal Information only as described below.

6.1.1   We may sell and publish personal information and data from the Service in an anonymized form for research and statistical purposes.

6.1.2   For the purpose of rating businesses within different industries, we publish data from the services, in an anonymized form.

 

7.    Third Party Services

7.1   This Privacy Policy addresses only the use and disclosure of Personal Information we collect from you. If you disclose your information to others, or if you are directed to a third party website, their privacy notices and practices will apply. These third-party services may independently collect information, including personal information, from you and, in some instances, provide us with information about your activities on those services. We recommend that you consult the privacy statements of all third-party services you use.

8.   Legal protection

8.1   We may release Personal Information when we in good faith believe that release is necessary

-   to comply with legal requirements;

-   to enforce or apply our conditions of use and other agreements; or

-   to protect our rights, property, or safety, our employees, our users, or others.

This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

8.2   Except as set forth above, you will be notified when your Personal Information may be shared with third parties, and you will be able to prevent the sharing of this information.

 

9.   Security

9.1   Your Livingroom account is protected with a password for your privacy and security. You should ensure no unauthorized access to your account by selecting and protecting your password appropriately, and by signing off when finishing accessing your account.

9.2   We do our best to ensure that user account information is kept private. However, we cannot guarantee the security of user account information. Various instances such as unauthorized entry/use, hardware or software failure, and other factors, may compromise the security of user information.

 

10.   Your Rights

10.1   You have the right to request access to and receive information about the Personal Information we maintain about you, update and correct inaccuracies in your Personal Information, and have the information blocked or deleted, as appropriate.  You also have the right to object to our processing of your Personal Information and withdraw your consent to our processing of your Personal Information at any time. The right to access Personal Information may be limited in some circumstances by local law requirements. Please note that you may not be able to benefit from all features if you request the deletion of your Personal Information, object or withdraw your consent to the processing of your Personal Information.

10.3   You also have the right to complain about our processing of your personal information to the Danish Data Protection Agency.

10.4   If you would like to exercise your rights or withdraw your consent, please do so by closing down your account with us.

 

11.   Amendments to Privacy Policy

11.1   This Privacy Policy may be amended from time to time with a 30 days notice and will require your consent to come into force.

11.1.1   If you do not want to consent to our new privacy policy you may not be able to use our services.
